District 5, approving said elections and the results thereof

Ordinance No.2013- 14
An ordinance canvassing the returns and declaring the results of the Runoff
Election, held on June 15, 2013, for electing a City Council Member for Super
District 5, approving said elections and the results thereof, delegating authority,
declaring an emergency; and providing an effective date.
Whereas in accordance with Article II, Section 3 of the City Charter Chapter 2,
Section 2 1
- of the Victoria City Code, and the laws of the State of Texas, by Ordinance
No. 2013 1
- 3 a Runoff Election was called for the purpose filling the vacancy on the City
Council for Super District 5 on June 15, 2013;
Whereas City Council must officially canvass the votes and declare the results of
said election within the time required by the laws of the State of Texas and Article.VII of
the City Charter;
Whereas the City Council finds that the aforesaid elections were held in
accordance with the laws of the United States of America, the State of Texas, and the
ordinances and Charter of the City of Victoria;
Now therefore, be it ordained by the City Council of the City of Victoria,Texas:
1.
The City Council finds the results of the runoff election of the City of Victoria held June
15, 2013 are as set out in the election results attached hereto as Exhibit "A"
and made a part hereof for all
purposes as though copied herein verbatim; said election was duly called and notice thereof was duly
given; said election was held under and in strict conformity with applicable laws; only duly qualified
voters of the City voted at the election; and due returns of the election have been made by the proper
officers.
In accordance with the election results, the following people were elected by the qualified
voters of the City of Victoria, Texas for a three year
term as set out in Article II, Section 3 of the City

If any provision of this ordinance, or the application thereof to any person or
circumstances, shall be held invalid or unconstitutional by a court of competent jurisdiction, such
invalidity shall not affect the other provisions, or application thereof, of this ordinance which can be given
effect without the invalid provision or application, and to this end the provisions of this ordinance are
declared to be severable.
4.
The City delegates authority to Victoria County to perform any necessary acts to provide
City Council with documentation required to canvass and/or validate the results of this election.
5.
In order that the results of this election be made official within the time required by law,
requirement of Article II § 9 of the City Charter that no ordinance shall
be passed finally on the date of its first reading is suspended and this Ordinance shall become effective
immediately upon adoption.

Una ordenanza recorriendo los votos y declarando los resultados de la
Eleccion de Desempate, que se Ilebo acabo el 15 de Junio, 2013, para eligir
un Miembro del Consejo para Super Distrito 5, aprobando ser eleccion y los
resultados de eso, delegando autoridad, declarando una emergencia; y
proveer una fecha en efectivo.
Mientras que en acuerdo con Articulo II, Seccion 3 del Estatuto de la
Cuidad Capitulo 2, Seccion 2 1- del Codigo de la Cuidad de Victoria, y las leyes
del Estado de Texas, por Ordenanza Num. 2013 1
- 3, una Eleccion de Desempate
fue Ilamada para llenar una vacancia en el Consejo de la Cuidad para Super
Distrito 5 el 15 de Junio 2013;
Mientras que el Consejo debe oficialmente recorrer los votos y declarar
los resultados de ser eleccion entre el tiempo requirido por las leyes del Estado de
Texas y Articulo VII del Estatuto de la Cuidad de Victoria;
Mientras que el Consejo de la Cuidad halla que las elecciones antedicho
fueron sostenidas en acuerdo con las leyes de los Estados Unidos de America, el
Estado de Texas, y las ordenanzas y el Estatuto de la Cuidad de Victoria;
Por lo tanto, queda resuelto por el Consejo de la Cuidad de Victoria, Texas:
1.
El Consejo de la Cuidad halla los resultados de la eleccion de desempate de la
Cuidad de Victoria que se llebo acabo el 15 de Junio, 2013 son como segun precisado en los
resultados de la eleccion atado a esto como Exhibicion "A"y ser hecho una parte acerca de esto
para todo los propositos como si fueran reproducciones aqui dentro al pie de la letra; ser eleccion
puntualmente fue llamada y noticia por lo tanto puntualmente fue dada; ser eleccion fue sostenida
bajo y en estricto conformidad con leyes aplicables; nomas votantes de la Cuidad puntualmente
calificados votaron en la eleccion; y retornos debidos de la eleccion se han hecho por los oficiales
apropiados.
2.
En acuerdo con los resultados de la eleccion, las siguientes personas fueron
elegidas por las votantes calificados de la Cuidad de Victoria, Texas para un termino de tres anos
segun lo precisado en el Articulo II,Seccion 3 de el Estatuto de la Cuidad, como sigue:

Si cualquier provision de esta ordananza, o la aplicacion de eso a cualquier
persona or circunstancia, sera sostenido invalido o inconstitucional por una corte de jurisdiccion
competente, tal invalidez no debera afectar las otras provisiones, o aplicaciones de eso, de esta
ordenanza que puede ser dada efecto sin invalida provision o aplicacion, y para este fin las
provisiones de esta ordenanza son declaradas que pueden ser severadas.
4.
La Cuidad delega authoridad a el Condado de Victoria para realizar cualquier
acto necesario para proveer a el Consejo de la Cuidad con documentacion requerida para recorrer
y/o validar los resultados de esta eleccion.
Para que los resultados de esta eleccion ser official dentro de el tiempo requerido
es declarada y el requerimiento de Articulo II § 9 del Estatuto de la
Cuidad que ninguna ordenanza sera pasada finalmente en la fecha de la primera lectura es
suspendida y esta ordenanza sera efectiva inmediatamente sobre adopcion.
